AI Based unverified Submission – Bombay High court imposes costs – A wake-up call for professionals

In a first-of-its-kind observation in a CWP, a HC has flagged the perils of unverified AI-assisted submissions.

HC noted that Respondent-Heart & Soul Entertainment Ltd had filed documents in Feb and April 2025 that appeared to be generated using AI tools like ChatGPT, showing signs such as repetitive formatting, green-box ticks, and incorrect or non-existent case references.

While acknowledging that AI tools can aid research, the HC emphasized that all content must be verified, as filing unverified AI-generated material wastes judicial time and hinders justice.

As a consequence, the HC imposed costs of Rs. 50,000/- … underscoring the importance of human oversight and professional responsibility even in the age of AI.

This case serves as a strong reminder for all that AI is a tool, not a substitute for diligence, verification and above all, real intelligence.

The copy of the order is as under:

WRIT PETITION NO. 8390 OF 2009
