SC order on Trans 1 Credit:   The GSTN Portal to be kept open for filling Form TRAN-1 & TRAN-2 for two months

 

The Supreme Court in the case of Filco Trade Centre and other SLP’s on transitional credit has ruled in favour of taxpayers. The summary of the order is as under:

1. The GSTN Portal to be kept open for filling Form TRAN-1 & TRAN-2 for two months between 01.09.2022 to 31.10.2022.

2. The benefit to be extended to all GST taxpayers to file relevant forms or revise the already filed form irrespective of whether the taxpayer has filed writ petition or not.

3. GSTN to ensure that there are no technical glitches on the GSTN portal during the said period.

4. Concerned officers are given 90 day’s time to verify the Transition form filed and pass order on merits by providing an opportunity of being heard.

5. On satisfaction of claim by concerned officers, the transition credit to be credited to electronic credit ledger on GSTN portal

6. GST Council may issue guidelines for the aforesaid if needed.
