CBDT Circular enhancing the monetary thresholds for filing appeals by the Department against orders passed in favor of the Assessee

 

In line with the Finance Minister’s Budget announcement, the CBDT has issued Circular No. 9 dated 17.09.2024, increasing the monetary thresholds for filing appeals by the Department against orders passed in favor of the assessee. This change will impact all pending appeals as of today.

Here are the enhanced limits:

– Appeals against CIT (Appeals) to ITAT: ₹60 lakhs

– Appeals against ITAT orders to High Court: ₹2.00 crore

– Appeals against High Court orders to Supreme Court: ₹5.00 crore

Additionally, the Department Representatives (DRs) have been instructed to withdraw existing appeals below these new thresholds.

This move aims to reduce litigation and focus on significant cases.
