Refund of excess equalisation levy paid- Interest is also payable thereon
Hon’ble Bombay High Court vide judgement dated 18.12.2023 on issue of interest on refund of excess equalisation levy paid, has held that Petitioner is entitled to interest on excess of equalisation levy refunded and contention of department that there is no provision in this regard so no interest is payable on refund of equilisation levy is not tenable following principle laid down by Apex Court in the case of Tata Chemicals.
