Extension of the date of filing statement of Donation of FY 2022-23 in Form No. 10BD & certificate in Form No. 10BE extended to 30th June 2023.
CBDT has issued the “Clarification regarding provisions relating to charitable and religious trusts” on 24th May 2023 wherein the date of filing the statement of donation in Form No. 10BD has been extended from 31st May 2023 to 30th June 2023
The relevant part of the notification reads as under:
Extension of due date for furnishing of Form No. 10 BD.
“ 9. In view of extension provided to funds or institutions seeking approval under sub-section (5) of section 80G of the Act, as discussed in paragraph 5(i), in the exercise of the power under section 119 of the Act, the Board also extends the due date for furnishing of statement of donation in Form No. 10BD and the cel1ificate of donation in Form No. 1OBE in respect of the donations received during the financial year 2022-23 to 30.06.2023”
One may note that all the Charitable Trust are required to file the Statement of Donation received in Form No. 10BD for which the original due Date was 31st May. After filing the Form No. 10BD, trust are required to issue the certificate to the donor in Form No. 10BE/
The key feature of Form No. 10BD:
Donations eligible u/s 80G received by Trusts for Financial Year 2021-22 need to be filled in *Form No. 10BD* and should be electronically uploaded & signed by the Managing Trustee/Office Bearer before 31st May 2022.
Following details to be filled up
- Name of donor.
- Address of donor.
- Nature of donation.
- Mode of receipt.
- Amount of donation.
- Section code under which donation was received.
- PAN No. /Aadhar No./ Tax Identification No. of the donor (in case of Foreign donor)
After uploading Form 10BD, *Form 10BE* has to be downloaded and this *Certificate of Donation* is to be issued to each Donor before 31st May of every year and containing following details.
1) Name of Charitable Organization.
2) PAN
3) Aadhar
4) Approval number u/s 80G
There is a heavy penalty and late fees for not filing the form.
Late fees shall amount to Rs 200/- per day for delay in uploading Form 10BD.
The Assessing Officer may also impose a penalty from minimum Rs. 10,000/- to maximum Rs 1,00,000/-.
