CBDT: With regard to feasibility of email, the instruction remains the same.
Hon’ble Guj HC: Mr. Vyas, ask the highest authority to file an affidavit to fix the problem and if the problems are not attended, the officer will be personally responsible for the same. If CBDT is to adopt a very obstinate attitude, which we don’t appreciate, they should also keep in mind the problems which the assessees are facing as of date.
There is no good reason for CBDT to become very happy because 35% of the assessee of the country have been able to upload their audit report, 65% of the assessee have yet to file their reports and their returns, and now we are left with less than one month. Therefore, we will not issue any directions to the CBDT, but at the same time, we want an assurance from the HIGEST officer of the CBDT that if any technical glitches crop up and any assessee finds it difficult to upload the audit report, the same problem will be attended within 48 hours and whatever means they would like to adopt.
We want you to file this affidavit from the HIGEST authority within 48 hours and place on record. We dispose off both the petitions. If the glitches continue even till 10th of February, then we shall issue a writ, which shall have an effect across the country and extend the due dates to 15th of March 2022.
Let us see what CBDT has to say about it. It is the duty of the CBDT as it is their portal. They are supposed to maintain and manage the portal.* We shall ensure that if any assessee faces any difficulty, they shall not be fastened with ANY liability. Assesses, they should not come begging before you. Please help us. And if there is any genuine problem, CBDT is expected to take care of it. Matter to be listed on Friday 21st January, on top of the board.
