No. PR-295/2014-DD/313/2014-DC/550/2017 and PR-33/2016-DD/97/2016-DC/1028/2019.—In terms of the provisions of Section 21B(3) of the Chartered Accountants Act, 1949 read with Rules 18(17) and 19(1) of the Chartered Accountants (Procedure of Investigations of Professional and Other Misconduct and Conduct of Cases) Rules, 2007, the Disciplinary Committee has held CA. Kotila Veetil Shankaran (Membership No. 033960), C 909, Mahavir Trinkets, Opp Kanjur Marg Railway Station, Kanjurmarg West, MUMBAI 400 078, guilty of Professional/Other Misconduct falling within the meaning of Item (10) of Part I and Item (4) of Part II of the Second Schedule( in the first case) and Item (10) of Part I of Second Schedule and Item (2) of Part IV of the First Schedule (in the second case), to the aforesaid Act and consequently vide orders passed in meetings dated 18th August, 2020 and 27th May, 2021, ordered for removal of the name of aforesaid CA. Kotila Veetil Shankaran (Membership No. 033960) from the Register of Members for a period of 05(Five) years and also imposed a fine of Rs. 1,00,000/- (Rupees One Lakh) only in each of the above cases. The Disciplinary Committee vide order passed in meeting dated 27th May, 2021, further ordered that if the Respondent, CA. Kotila Veetil Shankaran (Membership No. 033960), fails to deposit the fine within the stipulated time i.e. 30 days, his name should be removed from the Register of Members for a further period of 06(six) months. The Committee also clarified that the punishment shall run concurrently in both the aforesaid cases. Since, the Respondent failed to deposit the imposed fine as stipulated, in pursuance thereof and in exercise of the powers conferred by sub-section (2) of Section 20 of the aforesaid Act, read with Regulation 18 of the Chartered Accountants Regulations, 1988, it is hereby notified that the name of said CA. Kotila Veetil Shankaran (Membership No. 033960), shall stand removed for a consolidated period of 05(Five) years plus additional 06(six) months from the Register of Members with effect from 26th November, 2021.
