Income Tax Survey power curtailed : Less Income Tax Survey in Days to come
As of now, both Investigation wing & AO had powers of survey as per section 133A.
Income Tax Authority u/ 133A is specified to include both as of now.
Further, rigours of search u/s 132 are stringent than survey u/s 133A so it was dedicated to DI wing.
Now, Going forward, Income Tax Survey will be conducted by Investigation wing and not by concerned AO.
Now, DG Investigation shall take up the potential cases and decide whether to do survey. It is brought to same footing as search cases.
There are various cases where the department has ended up the cases with survey where search was more promising. It was a very conscious and planned decisions of the best brains of the department.
