TAR Date Extension: Welcome Decision by Gauhati High Court

On 12th of October, 2018 an order by Gauhati High Court is passed considering Tax Audit Date extension for the Financial Year 2017-18 (Assessment Year 2018-19). It instructed Central Board of Direct Taxes (CBDT) to consider the representation for extension of due date upto 31st Jan, 2019. It asked CBDT to dispose off the representation filed on or before 25th Oct, 2018 by way of a speaking order.

The reason why the date should be increased was duly discussed by Court. It discussed elaborately the problems to be faced by assesses and accountants in case the date is not extended.

Gauhati High Court has given an open option to the assesses and the tax professionals to file Writ Petitions for date extension in case extension is not provided by CBDT.

This is very welcome and nice judgment by the High Court.

Have a look at the order for reference below.
